The article examines the mechanisms for implementing the national regime in the public procurement systems of Russia and Belarus, analyzing the legal instruments aimed at supporting domestic producers and restricting access of foreign goods to public procurement markets. The research identifies key differences and commonalities in the approaches of both countries to providing preferences for national products, including prohibition mechanisms, admission restrictions, and quota systems for Russian goods. Particular attention is given to the transformations in Russian legislation that entered into force on January 1, 2025, associated with the adoption of Government Decree No 1875, which unified the rules for granting the national regime across both Federal Law No. 44-FL and Federal Law No. 223-FL. The study reveals systemic problems impeding the full realization of the national regime within the Eurasian Economic Union, including barriers to mutual market access, the absence of mutual recognition of electronic digital signatures, and insufficient harmonization of procurement legislation among member states. Based on the analysis of regulatory frameworks, enforcement practice, and statistical data, the authors formulate proposals aimed at improving the effectiveness of protectionist policy in the procurement sphere while maintaining a balance between supporting domestic production and ensuring healthy competition. The practical significance of the research lies in identifying specific problematic aspects of applying the national regime that require legislative solutions at both the national and supranational levels.
